Terms of Service Agreement

These Terms of Service ("Terms") govern your access to and use of the PingMe dashboard, Discord bot, and related services. Please read these Terms carefully before using our services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Acceptance of Terms

By creating an account or using PingMe, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

These Terms constitute a legally binding agreement between you and PingMe. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

To use our services, you must:

  • Be at least 13 years old (or the minimum age required by Discord in your jurisdiction)
  • Have a valid Discord account in good standing
  • Not have been previously banned from our services
  • Comply with Discord's Terms of Service and Community Guidelines

3. Account Registration

You create an account by authenticating through Discord OAuth. By doing so:

  • You authorize us to access your Discord profile information
  • You are responsible for all activity that occurs under your account
  • You must not share your account access with others
  • You must notify us immediately of any unauthorized access

4. Subscription & Billing

Free Tier

Basic features are available at no cost. Free tier features may be modified at any time.

Paid Subscriptions

  • Subscriptions are billed on a recurring basis (monthly or yearly)
  • Payments are processed securely through Stripe
  • Upgrades are applied immediately with prorated charges
  • Downgrades take effect at the end of the current billing period

Cancellation & Refunds

  • You may cancel your subscription at any time through the dashboard
  • Access continues until the end of the current billing period
  • No refunds are provided for partial billing periods
  • Server activations are deactivated when the subscription ends

5. Acceptable Use

You agree not to use our services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Violate Discord's Terms of Service or Community Guidelines
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Distribute malware, spam, or harmful content
  • Reverse engineer, decompile, or disassemble any part of our services
  • Use automated tools to scrape or extract data from our services
  • Circumvent any security measures or access restrictions
  • Resell, redistribute, or sublicense our services without authorization

Violation of these terms may result in immediate suspension or termination of your account.

6. Intellectual Property

All content, features, and functionality of PingMe (including but not limited to text, graphics, logos, code, and software) are owned by us and are protected by intellectual property laws.

You retain ownership of any content you create using our services (such as bot configurations). By using our services, you grant us a limited license to store and process your configurations as necessary to provide the service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to our services. Our services may be temporarily unavailable due to:

  • Scheduled maintenance and updates
  • Discord API outages or rate limiting
  • Infrastructure provider issues
  • Force majeure events

We will make reasonable efforts to provide advance notice of planned maintenance.

8. Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms of Service
  • Violation of Discord's Terms of Service
  • Fraudulent or abusive behavior
  • Non-payment of subscription fees
  • Extended inactivity (with prior notice)

You may also terminate your account at any time by contacting us. Upon termination, your right to use the service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We are not responsible for any actions taken by Discord that may affect our services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through our Discord server or by updating the "Last Updated" date at the top of this page. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PingMe operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
